Terms of Service

These Terms of Service govern access to and use of LearnMatch, including its website, course and school listings, optional assessment, maps, and related features (collectively, the “Service”). By accessing or using the Service, you agree to these Terms and to the Privacy Policy. If you do not agree, do not use the Service.
1. Acceptance and scope
These Terms form a binding agreement between you and LearnMatch concerning your use of the Service. If you use the Service on behalf of an organisation, you represent that you are authorised to accept these Terms on its behalf. These Terms apply in addition to any terms imposed by third-party services that you choose to access through the Service.
2. Nature of the service
LearnMatch helps users search Philippine higher-education courses and institutions and, if they elect to do so, generate an assessment-based set of course considerations. The Service is provided for general information and research only. It is not a licensed guidance, counselling, legal, financial, medical, admissions, or accreditation service.
An assessment result is generated from the responses you provide and the methodology then used by the Service. It is not a statement of aptitude, a diagnosis, a ranking endorsed by an institution, or a recommendation that you must follow.
3. Eligibility and local storage
The Service is intended for prospective students and the people supporting them. Users under the age of 18 should use it with an appropriate parent, guardian, teacher, or other responsible adult where required by applicable law. The Service does not provide a production account or payment facility.
Assessment profiles, results, and any demonstration profile details may be stored in your browser. You are responsible for the security of your device and for clearing local browser data if you do not wish to retain those details.
4. Acceptable use
You must not, and must not permit any other person to:
- use the Service for an unlawful, fraudulent, defamatory, or harmful purpose;
- scrape, crawl, bulk-extract, reproduce, or redistribute Service data by automated means without prior written permission;
- circumvent rate limits, access controls, technical safeguards, or security measures;
- interfere with the availability, integrity, or security of the Service or another user’s access to it;
- misrepresent an affiliation with LearnMatch, CHED, DepEd, or any institution; or
- use the Service in a manner that infringes another person’s rights or violates applicable law.
We may investigate suspected misuse and restrict, suspend, or block access where reasonably necessary to protect the Service, users, or third parties.
5. Information accuracy and decisions
Course and institution information is compiled from CHED Program Specification Guidelines and other public sources. Information may be incomplete, inaccurate, unavailable, or out of date. In particular, offerings, fees, admissions requirements, recognition, accreditation, schedules, locations, and contact details may change without notice.
You are solely responsible for verifying information with the relevant institution and for decisions you make in reliance on the Service. Do not rely on LearnMatch alone for an enrolment, financial, career, travel, or relocation decision.
6. Intellectual property and institutional materials
Subject to these Terms, LearnMatch grants you a limited, personal, revocable, non-exclusive, non-transferable right to use the Service for lawful research purposes. LearnMatch and its content, design, software, and marks are protected by applicable intellectual-property laws. No right is granted except as expressly stated.
Names, logos, seals, trademarks, and other institutional materials remain the property of their respective owners. Their display identifies an institution and does not imply endorsement, affiliation, verification, or sponsorship. Rights holders may contact us with a substantiated correction or removal request.
7. Third-party services and links
The Service may link to or rely on third-party websites and services, including institutional websites, mapping, routing, analytics, and advertising providers. Those parties operate under their own terms and privacy notices. LearnMatch does not control, endorse, or warrant third-party content, availability, data practices, or results.
8. Disclaimers
To the maximum extent permitted by applicable law, the Service is provided on an “as is” and “as available” basis. LearnMatch disclaims all express, implied, statutory, and other warranties, including warranties of accuracy, completeness, availability, merchantability, fitness for a particular purpose, non-infringement, and freedom from errors or harmful components.
Nothing in these Terms excludes or limits a warranty, condition, remedy, or right that cannot lawfully be excluded or limited.
9. Limitation of liability
To the maximum extent permitted by applicable law, LearnMatch and its operators, contributors, and service providers will not be liable for any indirect, incidental, special, exemplary, punitive, or consequential loss, or for loss arising from reliance on the Service, a third-party service, course information, assessment output, or travel estimate.
Nothing in these Terms limits liability for fraud, wilful misconduct, death or personal injury caused by negligence, or any liability that cannot be excluded or limited under applicable law.
10. Philippine law and jurisdiction
These Terms and any non-contractual obligations arising from or connected with them are governed by the laws of the Republic of the Philippines. Subject to the following section and to mandatory law, the competent courts of the Philippines shall have exclusive jurisdiction over disputes arising out of or relating to the Service or these Terms.
11. International use and mandatory rights
The Service is designed primarily for the Philippines but may be accessed elsewhere. You are responsible for complying with laws applicable to your use from your location. Where a consumer, privacy, or other mandatory law in your country grants rights or remedies that cannot be waived or restricted by contract, those rights and remedies remain unaffected. Nothing in these Terms is intended to exclude compliance with applicable Philippine law, including Republic Act No. 10173 (Data Privacy Act of 2012), or applicable mandatory international law.
12. Changes, suspension, and termination
We may amend these Terms, suspend features, or discontinue the Service where reasonably necessary for operational, security, legal, or business reasons. The “Last updated” date identifies the current version. Material changes will be posted on this page or otherwise communicated where required by law. Continued use after the effective date constitutes acceptance to the extent permitted by law.
